Dryvit Denies It Issues Warranties

In what appears to be a desperate attempt to fend off lawsuits, or just annoy plaintiff's attornies, Dryvit has begun denying the fact that it issues standard, express warranties for their products. This is apparently happening only to those who have legal action pending. A call to Dryvit's technical support line, 1-800-4DRYVIT this morning (13 April) confirmed that Dryvit still tells the home-owner to contact the original distributor of the materials. The distributor is then supposed to forward the paperwork to Dryvit. Dryvit then issues the warranty to the distibutor, who may send it directly to the home-owner, or send it to the applicators, who send it to the builder, who was supposed to issue the warranty to the home-owner in the first place. ??

However, if you have a lawsuit underway, it appears that you can expect Dryvit's attorney to tell your attorney that Dryvit simply does not issue standard, express warranties. This is, of course, total b.s. as Dryvit has been issuing them since at least 1982.

So, how does one's attorney prove this? Simply obtain a copy of Dryvit's specification for the system you have. Make sure the specification is dated for the year your system was installed. For instance:

On page 7, Section 1.10, "Limited Materials Warranty" of Dryvit publication DS118, Outsulation: An Exterior Wall Insulation and Finish System, dated 1983, 1987, 1990, 1991 and 1996, Dryvit states "Dryvit Systems, Inc. shall provide a written, standard five (5) year limited warranty against defective materials, upon written request."

The Table of Contents for the Dryvit Outsulation Specification, dated 1992, states "The liabilities of Dryvit Systems, Inc. shall be as stated in the Dryvit Standard Warranty. Contact Dryvit Systems, Inc. for a full and complete copy of this warranty".

Or, obtain the mother of all warranty documents, Dryvit Systems, Inc. Warranty Program. This document describes the warranty program for all Dryvit products. The opening paragraph reads:

"Dryvit Systems, Inc. warrants all of its products and systems for a specific period of time depending on the systems or products used. Below is a desription of the basic warranty terms for the various products and systems, as well as the limitations and restrictions that apply. Samples of specific warranties are available by contacting Dryvit's Warranty Services Department".
