Is this settlement fair?
Short answer, NO. This is by far the worst settlement I have
seen to this date. The deductions are severe, the process to claim, difficult.

How much money will I get?
In short, you will receive a reginally adjusted amount
times the total square feet of DAMAGED siding minus age difference. The
age deduction is 4% per year, plus a deduction of 4% if the house was not
painted every 5 years.
Is this amount enough to fix my house?
NO. In every settlement so far, the amount provided as an "average"
cost of removal, repair, and paint is far below the lowest estimate available.
At least here in Texas where the regional adjusted price is about $4.25,
the REAL average is somehwere in the $8.00/sq ft range.
What is the regionally adjusted price for my city?
The regionally adjusted price per sq ft is claimed to be the
average of what it would cost to remove, replace, and paint new siding.
Of course it has been our experience that this amount is lower than any
low cost of repair. You can call the claims admin and ask how much the
regionally adjusted price for your city is.
What does it mean "Damaged" siding?
Damaged is defined in the settlement document and is much to
complicated to describe here, but see http://www.sidingclaims.com/damaged.shtml
for some mpost common descriptions of damage. Most settlements are paying
only for damaged siding regardless of the jury's findings.
What does it mean by age deduction?
They will take a percentage off your settlement based upon
the age of your siding. 4% per year. So if your house is just 10 years
old, you immediately get a 40% deduction.
How do I apply for the settlement?
Visit www.abtcoclaims.com or call the 1-800 number and ask
for an application.
What is the overall process?
The general process is apply for the settlement, they will
provide an "Advanced Payment Program" offer, accept the offer and be paid.
I've replaced my siding already. Can I still apply?
Yes in most cases. The repairs MUST have been completed BEFORE
a certain date and homeowners have only a certain amount of time to file
a claim. More details will follow.
How long does it take to apply?
About 6 months from application to check in hand. Some are
quicker, some are not. If you have reasons to expedite, then it could be
quicker, such as putting your house up for sale. According to the settlement
the claims admin is suppose to have an inspector at your house within 2
months of receiving your application. That has been the exception, not
the rule. The settlement is also worded so there is no possible enforcement
of this clause.
I've applied months ago and haven't heard from the claims admin. What
do I do.
Call 1-800 number and ask why.
