1. We were told for Months that our credit was good to go, so we listed our current house and sold it in one day. NOW we are told our financing is a no go. We have to vacate our current home in 2 weeks and we will be basically homeless. 2. We contracted to build our home based on a model and exact duplicate built in the sub division. Nothing in our home is representative of these 2 examples. The electric panel is on a main basement wall, where the plans clearly put it in the garage. We asked about this and got " thats the way it is. Sump pump is in an outside corner of the finished basement, and the water meter comes in on another main wall. Nothing is in the utility room except the furnance and the water heater. We have been lied to throughout the whole process.

Dear Hadd, This is regarding a warranty service to a master bathroom garden tub. Complaint was that when stepped in the tub flexes and creaks. Builder attempted to repair by cutting an access hole in the wall in an adjacent room. 4 foot long wedges were hammered between the tub body and floor followed by filling accessible areas with expanding foam. This did not correct the problem and may have aggravated it. I requested the engineering that the repair was based on. My request was denied. The builder has refused to complete the work stating that it was done as a courtesy and they had no obligation to complete the repair and claim it was installed per manufacturers instructions. Further more I was told to pay to complete the repair or contact the 3rd party warranty service. My position is that the builder started the work and is obligated to finish it. Sincerely, John Norman

The Contractor took draws and did not pay his subs. In order to avoid a lein against my home, I had to pay out of pocket $3950.00. for air conditions my cotractor was paid for. Also, the house never received electrical outlets to the outside as was in the contract. Mr. Sears lives next door and has ignored my telephone calls, letters and communication. He has been in financial difficulties and has been using monies to pay his bills and live on and has ended any kind of communication I have attempted.

permit applications submitted to EPA were falsified regarding if any area of project was in a flood plain. 7 acres are in a FEMA zone x shaded 0.2% flood plain(map # 170720 panel 0239, suffix D). Lot 41 willingham (our home) was built on soil unfeasible for dwellings with basements according to NRCS reports, and original soil report spoke of problematic soil in our location, and the need for specil design footings/foundations. We hired geotecs, our soil is less than 500 psf, very loose and unstable. Fondation is cracked north and south walls, water leaks in cracks. basement floor is severly cracked and heaved. a river runs through back yard perminately. No exterior footing drain tile was installed (IRC foundation drainage law,) as our contract specified. Builder refused to rough grade our lot and remove old barb wire fence on our property. 2 toilets are leaking, brazillian cherry hardwood floors look like a cheese grader. The list goes on and on. Where is the quality control for residential construction in America? These inspectors need to be hired through state and or federal departments. This way their jobs will not be in jepordy in fear of the builder for insisting things are done properly. sincerely, Robert C.

after three years my septic was installed wrong now i have to repair at over three thousand dollars. Which I paid to install with my builder Cobra Construction three thousand dollars three years ago. All my plumbung does not work properly My sinks are cracking and leeking also toilets. windows are mold and cracked on the sides. walls are cracking.they never sanded my joints so the paint is falling off the walls.all my side walks are cracking.floors are coming up. doors have been repaired. leeks from the bath tub under the floor had to be torn out and repaired. now my bathtub has scratches from tial falling on it while repaired by cobra. Windows wont work.Carpet was cut to short now it's coming up. Burned my window molding while building never repaired it.doors have big dents in them from construction and never repaired.Aldready had to repair air on our ac unit. worse part is the septic the company that pumps it for us told us this builder keeps them in business because of the plumbing defects..How can this be people work hard to have homes and then you have builders that screw you AND GET AWAY WITH IT.

This is one of the several emails I have sent to BEAZER HOMES... I bought my first brand NEW house on Jan 2 2008 and being a single mother of two have worked two jobs to afford our home, our dream I thought had finally came true. Instead I'm living a complete nightmare. I haven't been able to enjoy my house neither have my two kids age 11 and 9. They cant even go to the backyard and play and its been 22 months since we moved in. Mold growing in the master bedroom window. The water sits on the property and fungi and mold have grown very bad on the property not to mention the snakes have moved in. It smells like crap and its muddy everywhere. They don't even sleep in their rooms due to the temperature is whatever the garage is. No matter how high, low I set the temp and ceiling fans on does not help. Not to mention our health has been affected since we moved in. My son since he was born has been the most healthiest child only would have to take him to doctor for annual checkups. Now he has trouble breathing, chest pains, always tired, constant migraine headaches, as well as my 9yr old and myself. My son recently had a Brain MRI and the results where not good. March 4, 2009 I was told there was a nodule in my lung. Further recent testing shows several nodules in my throat as well. I have had anxiety attacks, most recent yesterday evening. Crying not able to sleep well and angry, stress due to dealing with Beazer to get my house fixed correctly. God help me the day I signed the contract . I have been taken advantage of and I cant continue to fight this battle with Beazer. I have major foundation issues, the driveway and walk way have moved away from the house and cracked. There's several cracks outside and inside the house. All the builder has done is put a band-aid over them however more and more cracks continue to come out. Nails continue to pop out through out the house. Walls continue to get dents in them. I have been to patient with Beazer and truly thought the concerns would have been resolved. i cant trust Beazer anymore. I have been lied to several times. Builder Danny says one thing , Jay Nelson says this and workers say another. I'm not just talking about the dirt either, talking about several other things. There is lack of communication with the builder Danny and Jay. I cant have BBQs or rent a bounce house, have guest come over due to the backyard and sides of house smells like crap. I cant even open the windows, hmm wonder if they even work since I have not been able to opened them since last year. A few workers for the builder has told me the smell is due to the dirt used is from the landfills. The manager tells me that the smell will eventually go away. Its been 22 months and it still hasn't gone away and just last week adding more dirt its even worst. Manager of course denies the workers comment of where the dirt came from but the builder Danny said it was sand but that the guys screwed up and used something else when I confronted him with what his workers said. You can see the support beams on the ceiling and twice already they have tired to re-texture the ceiling however you can still see it. Finally last Friday the builder Danny, Jay and I met and they had advise they have to remove the entire ceiling and redo. Monday, I waited once again for the workers however he was clueless on what to do. Danny advise it will be until Thursday he can get a guy out to suck up all the insulation before knocking the wall down. However the guys came and did a lot of hammering and I leave to a Dr. appointment and pickup the kids from school. We get home and the guy is re-texturing the ceiling again and I got angry. Called Danny no answer, called Jay and told him whats going on. He said they have found a better way to get the support beams from weighing on the ceiling. I told him I can still see the support beams as we speak even after the guy put some white stuff over it. He said he didn't want to have me and the kids looking up at the roof of the house and was not going to tear down the ceiling. I can not continue talking about yesterday due to my chest is starting to hurt. I sick of hearing how Beazer went over budget building my house, Jay telling me that he does not want me to feel like they are cutting corners when DAME IT that is exactly what their doing. I don't want a temporary fix, I may not know much about building a house but I am not a stupid woman. I have heard the builder mention the concern of how much things cost to repair my house and that's is not at all fair to me and my kids.We shouldn't have to pay for this because of an over budget on this house and how much more its going to cost to repair it. We shouldn't have to live here while repairs are being made. I shouldn't have to clean off the paint and other materials used after work is completed. We shouldn't have been ALLOWED to move in this house with the builder knowing they cut corners and now I, we have to live with these not anyone else. Cost seems to be you guys concern and not my families mental and physical well being despite the several out cries I made to you guys. I have several photos, phone records that shows the several calls I made that went unanswered for the pass 22 months , emails, tape recorded conversations, medical records and at this point all I can think of is to attempt to seek help some where else. You guys must admit that I have been way to patience. I even stressed how I wanted to have everything completed by Thanksgiving week due to the plans are to have Thanksgiving at my house this year. I have family coming in from town starting on the 21st., ugh. This is so UNFAIR and VERY MEAN for you guys to treat me and my two kids this way. Please, help me!! Who else can I contact to help me!!!

Three years ago my family purchased a 3000 square foot home from Adams Homes of North East Florida. This was supposed to be a wonderful thing for me and my Family of Seven. We moved in and started having plumbing backups in toilets. Builder sent out their Plumbers, Gunderson Plumbing company. The employees from Gunderson Plumbing advised my family that they didn't do the plumbing in my home and that the plumber that installed plumbing in home had been fired by the builder. They advised us that the plumbing was not ran according to the builders blueprints and that they had no idea where the plumbing pipes even were under the home, since they were not ran according to plan. They felt that the home had possible sag in line causing backups, but had no idea how it could be fixed. We were told to wait to see what the builder would do, because Gunderson Plumbing was not liable, they didnt install the system. But, the builder seemed to be stalling us, we had difficulty getting them on the phone from then on. We ended up having another clog few weeks after the first. Gunderson Plumbing came back to home, this time they found toys in two of the toilets, small fisher price animals, but all three toilets had been clogged when they came to home. So they said they knew that the toys didn't cause the issue of the clog but the builder was stating that was the case and they refused to pay the plumber. I went ahead and wrote check, and Gunderson didn't even cash it after we spoke to owner. That was very kind of them. From that visit on, the builder stated there is nothing wrong with the house. They say the issues were caused by toys. They refused to address the fact that the plumbing was ran in wrong direction, they refused to do anything for us. So we got the Clay County Water Company to come and check the outside line running to the main sewer connection to make sure that their part of plumbing system was not defective. The water company ran a camera thru the outside line and found sags in the pipes that would cause backups into home. They gave me paperwork showing exactly where each sag was and how big they were. The main connection their part was fine. At this point with proof that the home had defect, and Builder refusing to do anything I decided to picket Builders Model Home. I wore a wood sign, and painted My Adams Home is Defective on the front, and Adams Homes says to flush twice on the back. Cause that is what the builder said I needed to do to fix, just flush more then one time. The Saleslady was angry about my protest and begain to turn the reclaimed water sprinkler system on everyday whenever I was there, she only turned on the station that I was standing by, and had the sprinkler heads turned to hit the sidewalk and me. This was their attempt to make me leave. The Builder I guess got tired of me being up on sidewalk everyday, and called the Bonded Builder Warranty group into situation, the warranty group does not take over warrantys till after first year but we were being forced into meetings with them and builder instead. So I stopped protest to give them a chance to see if they would fix home. The bonded builder came and told Builder to video the inside and outside lines to make sure they were properly installed. So the Builder hired a company to video the pipes, The warranty person Fred and the plumbing company came and videoed the house. When they tested the master bathroom toilet to see how the flow was they turned on the shower to assist in pushing toilet paper from the toilet to the outside line. So am I supposed to run shower every time I flush to make it work right? The Bonded builder sent us a letter few weeks later stating that there was nothing wrong with home and issue was caused by the toys. I was so upset, how could that be, we already had paperwork from Water Company showing Sags in outside line. How did the Builder get past that in their video. So I hired a outside plumbing company myself. I stood outside and watched him video the line, he showed me every sag he saw. He found the same ones the water company did on outside line, and he also found a 20 foot one in middle of my home in main line. So I knew then there was some sort of cover up going on, and builder was being deceptive. I got paperwork from plumbing comany and video. So I decided to started back on my protest, cause I know my home had defect. I had a video now to back it up. But then we got a letter from Builder Stating if I didn't stop protesting them they would sue me for slander, cause there was nothing wrong with the home. So we had to go and hire an Attorney. The Attorney advised me not to picket anymore that he would help us from there in going thru the arbitration process with the Bonded builder. He submitted out video and paperwork from the Water Company to the Builder and Bonded Builder. I called the Bonded builder and requested a copy of the Video that Adams homes had done of my plumbing lines. I wanted to see why they thought there was nothing worng with plumbing, The bonded Builder informed me that they never viewed the video from Adams but, that after Adams Homes did the Video they called them and told them everything was fine and that it was the Toys that cause the issue. So now I knew why the Bonded builder said it was just toys, they never even looked at the video. Adams just called them on phone and said whatever they wanted to with no proof. When we had our meeting with the Bounded builder , Adams homes , & our Attorney. They refused still to fix the home. Stating that all we had to do was flush more, that sags were acceptable, and that the large crack in our foundation that we found was just settling. The Bounded Builder that is supposed to be impartial, sided with the builder, even though we had by then 2 videos showing sags thru inside and outside pipes. We also had an Engineering report from an Engineer stating all the codes that were violated that caused the plumbing to sag and cracks in floors of home. So no resolution was made on my defects at meeting. They said they can't prove what is happening under the home, so they are not going to do anything. So we durring this whole time we had been trying to get the Department of Professional Building Regulation to help us, and they looked at our proof and told us we had enough for them to investigate the issue. They are still working on it, have been for over 2 years. A few months ago, We decided to try to put flooring in a few of the rooms that wouldn't be touched even if house was replumbed. I started to find large cracks in other areas of home. Then I kept thinking about what Bounded builer said at the meeting we don't know whats under the ground. So I spent 4 days rippping all the flooring out of my home to see how bad our situation really was. I found quarter inch cracks running many different directions thru the home. We at this point called our homeowners insurance company, cause we realized maybe we were sitting on a sink hole or had ground issues causing plumbing problems and foundation issues. State Farm came and agreed that there were not normal settling cracks, they set up a core ground testing and other test to make sure we were not on sink hole. When the test came back, ot proved that the ground was not compacted to code before home was built, and that the concreet was not reinforceed properly. We were not on a sink hole. It was an issue with the home not being built according to code by the Builder. A quality Craftsmanship issue. So we with the help of a friend submitted the new Core ground testing to the Builder and the Bonded Builder, and the Bonded builder sent a representative out to look at cracks. He stated that they could patch the top of the cracks. But we already knew this wouldn't work cause there is another home in neighboorhood they did this to 2 years ago and she told me her cracks are back. This was only thinkgm he offered at that time, he stated that an engineer would be sent out to look further, he took photos and left. We have started to get estimates for the repairs oursevles and also opinions on how to fix both plumbing issues and foundation issues. The plumbing is going to be about 35k. That is the low estimate. We had two foundation companies come out so far, both say that the patch will not work. They both had two different ideas on how to fix. The first person said that she can fix but they will continue to possibly expand or we might get more cracking in future due to ground issues under home and further settling. Second company drill holes in foundation and then he puts this liquid stuff under home that turns ground into hard surface like concreet, he then works on cracks and fixes. He said that should take care of it, for 35k as well. Both companies could not guarantie the work. Then to top it all off, we get a letter from Bounded Builder Stating that we are no longer covered for the cracks due to Builder Craftsmanship Warranty being expired. These are same cracks that were there in the first meeting, these are the same cracks that they said were just settling issues. So they blew us off then and tell us we have expired now? What happened to the Engineer that they were going to send out to decide how to fix? Now they are just refusing again to do anything. Just like before we are being blown off on a legitamite claim. It is just crazy. The last three years have been so stressfull some days I don't even want to go on. I am now living with a Adams Home, with sagging plumbing and severly cracked floors that I can't even put flooring over till it is fixed. And if I could even afford to try to fix it, there is no guarantie it wouldnt get worse or come back. I can't sell it in this condition, and wouldn't want to even put this sort of thing on another person anyway. Even though the Builder sold it to me this way. They knew the plumbing was put in the wrong direction. But, they sold it to me that way without disclosing this information to me. They knew the cracks were bad, but they did nothing to try to find out why they were there, or try to fix the home. They sold it to me defective, and have done evrything possible to try to make me just go away. The only thing they have done is Blame the problem on me and my young autistic child. That is How Low Adams Homes will go to not have to fix one of their homes. They Will Blame an Disabled Child and his toys, instead of doing the right thing adn fixing the issue! I want Adams Homes to buy back this Defective house they sold to me, then they can live with the cracks, and maybe I can acutally go find a real quality home, cause this is not it! I would like and need your help. I recently bought a house and I bought a home warranty from nationwide warranty. I purchased it for 379.99 a yearly fee and if something breaks you call them then they dispatch a licensed contractor and then you call them to set up an appointment. Well I did that and a contractor came out to fix a broken sump pump. He went out to tell them the situation of the job and came back to tell me that it was not covered. I then disputed the charge because they said it had rust on the sump pump and in my contract it states on 9.1 (which I can provide to you) that if rust or corrosion they can decline the job. While the contractor was standing there I said there was rust in the well not the appliance that needs to be fixed they said no that is not what he stated. I then put the call on speaker and asked him why he said there was rust on the sump pump. He stated that they asked him if there were any signs of rust he said yes but the pump died because of normal ware and tare. He then said did not ask me if there was any rust on the pump you asked me was there any signs of rust. She said well it is declined. I then told them while he was standing there that the sump pump was made from plastic and it was impossible for it to be rusted. They then said it was declined. This went on for an hour or more. They then said I had to pay the $50.00 service call I said Hell no. They then suspended my account and I told them who cares you took my money anyway I am not using you ever again. Since I was stuck the guy then said he can sell me the parts he was going to install but I would need to find someone to do the job because without the insurance he charges $398.00. I then paid him $200.00 for the parts and got a friend to help me install it. This is the short version of this whole problem. I feel that this company is scamming not just me but others out of money. They make you pay a premium then make you pay a charge for the guy to come out in denying a claim that should not be denied. I have emailed these people ten times and I have requested all my money back. I have called and got names and no one will follow through. I have received one email requesting that they will give me the out of pocket expense minus the 50.00. I said that they breeched the contract by denying a claim that should not have been denied in the first place and there was no way I was going to pay the fifty dollars. I then told them I still have the sump pump in my position to prove to them that it was/is plastic. I have the ten emails I sent to you the phone calls of when I spoke to you were supposed to be taped and I have pictures and video of the sump pump. This started on 11/27/09 and it is still going on. They do not return calls or emails. I tell them that I work two jobs to support my family and that I get home late and the best way to contact me is by email and they call the house. When I am home the girl that calls is not there and when she is there I am not home. Please help me to get my money back. If needed, I can email you the pictures, contract and the emails to show you that I am not lying. Please I don’t work this hard to through money out the window

Home was not finished at time of closing, the gas fireplace does not work, both upstairs bedrooms are like refridgerators, the exhaust fan in the upstairs bathroom does not work right, none of the phone jacks work because the electrician didn't finish connecting the wiring, the garage door has had to be fixed, the roof leaks, we've already had to replace 2 faulty smoke detectors, the wine fridge is really crooked, the front door is hard to open, and we had to install a couple of the window screens ourselves. The builder refused to install a mailbox for the house, so we also did that ourselves. We paid $315,000 for this house, which is pretty expensive for Tulsa, OK, and the house is most definitely NOT worth what we paid for it! I have never owned a brand new house, and I am just floored by the amount of problems we've already encountered!

Both Air conditioners, electrical outlets, was told a fire hazzard, many plumbing issues, and was leaking when bought the home. Washer and Dryer, no vent for dryer, doors, and so much more. We live in Illinois and bought this home in Florida, and trusted the inspector to inspect the home as he had done for us before and we turned down many offers made because of his advice.We had to wait 2 days longer because we requested Lou, and now to find out he wasn't the one we sent out as requested, and was lied to on the phone the day of inspection, they guy imposed as Lou? 75 defects were submitted with photos as proof. Stucco is falling off after two years. The house was painted two times before we closed and after two years paint is falling off. The engineering of the lots throughout the entire neighborhood were done incorrectly causing flooding and erosion. Streets are falling apart at three years of age. Landscape missing throughout the entire subdivision. Substandard repairs continue with no permits being applied for. Current President of DR HORTON hasn't taken or returned any calls made to him. He's technically not doing his fiduciary obligation according to Real Estate law. We have shown them original blueprints pertaining to our subdivision where engineering plans were never finalized. No stamp or signatures of the lead engineers. We have suffered through three years of mudslides and flooding from this with lots of erosion. Our subdivision is the most expensive on of this golf course community and it looks like you're driving into a ghetto. We want DR HORTON to comply with the original plans and full fill their legal responsibilities in finishing our subdivision. It seems very apparent that DR HORTON has someone working within government agencies allowing them to continue getting away with this kind of blatent fraud. Their sale agent who wrote our contract also never disclosed this too us when she lives here too. We want major media attention brought to this now. Stop the real reasons real estate collapsed. Developers and builders will continue this kind of fradulent business practices until legal agencies start doing their jobs properly. Our Housing Market will continue to collapse more if something isn't done immediately. By the way our home went up $100,000 in a year over our neighbors home and it cost over a half a million for this kind of substandard work.

The problem here is that our home builder, Lance Ray of LR Signature Homes, abandoned the project in mid-December leaving our home about 1/3 unfinsihed. He left the state and has not returned and cannot be contacted. He owes us $46,000 for materials and labor that he did not pay for, this includes some of the subcontractors that he did not pay. Lance Ray also abandoned another homeowner, a neighbor of ours, owing them approximately $150,000. This home is only about 1/4 done. We are all senior citizens and have been devasted by the losses we have suffered. We are living in a garage and cannot finish our house at this time and don't know how we can recover from this. We would really appreciate any help out there or any suggestions someone can offer or ways to recoup our losses. We are desperate for any help.

My husband retired from the US Navy after doing 22 years and decided we need a home with a yard for our children because they endured him moving so much, never having a yard to play in, and never complaining. We looked everywhere and my husband liked Harford County because of the schools and the yard size you got with the homes. We selected a Ryan Homes aka NVR development called Clayton Vista after seeing an ad in the paper about their award winning customer service but it has been nothing short of a nightmare. The first thing that happened was during the lot selection process we selected a lot and the sales rep called another family into the office while we were sitting there and sold them the lot we selected. After selecting the lot next to it and putting money down on it she sold that lot to someone else while we were on vacation. We explained to her what our plans where for the home because she kept changing our lot selection and she explained that the lot next to our previous selection was better suited for the pool we wanted to have installed. We took her recommendation, switched to the remaining lot, and felt like we’d be alright from here on but that was not the case. The finance side was a nonstop battle. I tried to stay on top of everything because I did finances for the government but these people were very savvy. The paperwork changed almost every day. Even the day we settled we received different paperwork. We were told, “you could not use your VA benefits and arbitration was what was the safeguard to the consumer, don’t worry we have never had any problems “. We requested a 30 year fixed and at settlement while signing we were informed we had an interest only plus there was no occupancy permit. The settlement woman told us that not having the occupancy permit was not unusual and they’d get it to us. I only got one after hounding the county office after a year and it was dated for the date of settlement which was odd because there were items missing in the house that would have caused it to fail an occupancy inspection. The house and lot immediately started showing and having major problems. The land behind the home started eroding toward the home, water was coming from the hill behind the house , rocks were being forced out of the same hill behind the home, pieces of construction debris started showing up in the yard after rain, the home flooded with over 16 inches of water, the foundation has cracked on three sides and which allowed water to infiltrate into the home, the main header has cracked, the stairs are no longer level, we have had three documented propane leaks, the land the home sits in is considered life threateningly dangerous due to its instability which are clearly stated in the county records, we have sink holes all over the yard, the HVAC was not hooked up correctly and the home stays cold, the doors and windows are out of plumb, we have had water come through the exhaust fans, air comes through the fireplaces, the drainage tile system has collapsed and filled up with mud, lights turn off and on by themselves, the roof leaked into the home, and the home is covered in mortar. Please understand this is not all of the problems just the ones I can rattle off the top of my head right now. I have requested the builder just purchase the home back and give us our money so that we may live as safely as they do. We have been met with some of the worst responses. We have spent every dime we have had, we have done everything by the laws, and we are now going to lose everything because we cannot keep our family in this situation. My family has lost over 29k in personal belongings. Our insurance company says it is builder’s error and the builder says it’s an act of God. We lost my children’s memorabilia, my husband’s military memorabilia, and our things we acquired from his 22 years of traveling for the Navy and no one cares. The loan for the home was somehow put only in my name and I am disabled. During the process we were told that my score would be used for securing the best mortgage rate but we were never told that a loan of that amount would be funded by me because I could never afford a home of this amount! No matter how much we gave then as a deposit the house amount continued to increase. How is it we gave them 65K on a home and still ended up in an 80/20 loan like we gave them nothing? What is so sad is we would have never known that we had lending issues had Civil Justice not looked over our documents! The irony of it all was that his score was not significantly lower than mine was. I am submitting video because you have to see how my family and I have been living for the last two years and what we have been fighting. Words cannot do justice to our situation and we can no longer afford this fight. Something must be done regarding the Right to Repair Law and the Arbitration Clause because people are having to foreclose not because of poor decision but because homebuilders have the right to build substandard homes and the consumer is forced to keep them. Since the Arbitration Clause places a limit on what a consumer can recover and forbids a jury from hearing your case you never come close to getting back what you have lost if you win! Where is the accountability? How did these things pass? I should never have to keep what is supposed to be a brand new home that requires over 200K in repairs. My family’s safety should never be jeopardized because of a company’s bottom-line. I am still trying to figure out why my family has to keep this mess , let Ryan Homes repair it, and then for us to try and sell it to someone else. Why would I feel good about selling this to some else? Children cannot safely play in the yard and the thought of a propane explosion injuring someone would keep me up at night. I am very serious when I say my family is losing everything because we trusted a homebuilder. We really thought this would never happen to us. No one should ever work as hard as we have, get to the point where life should be easier, and have to start over again because a builder is not truly held accountable for constructing defective homes. Every time I hear of a home that has caught fire or exploded for no none reason I now wonder if this was due to defective building process or a poorly done occupancy inspection. If a builder knew that they’d have to purchased back a defective home; I am sure that the building industry’s corrupt builders would start creating better quality product or disappear from the industry. That is simple accountability. Note: I sent this letter some time ago and the situation has gotten worse. We have learned just how in trenched this company is in the community. A blind eye has been turned on inspections and code related issues that put purchasing families’ lives in jeopardy. We spent every dime that we had using the legal system but have been sadly surprised by the turn of events during the process. How could someone knowingly build a home on land that is considered by a county or city as life threateningly suitable? How can someone knowingly put a propane tank in the same unstable land and have no regard for the people living there? Why would anyone think that a brand new home should come with a 200K+ repair bill? Why would anyone think that my family losing everything we worked for is alright? Why as a parent, do I have to explain to my children, why it is so cold in our home and we have to leave? I hate watching my husband look so defeated because these people are taking everything from him. Why would we agree to a settlement that could cost my husband his position? Why would an attorney, we paid, suddenly turn on us because we won’t agree to terms that will cost us everything? Why should anyone have to carry a foreclosure when the builder was caught doing unethical business? Should a builder do the financing of the home? They have more to gain by padding the cost of the home. I am asking for some attention to brought to this issue because everyone who may have lost a home during this very shaky economy may not have realized just what happened to them. Moved into home on 10/15/08 and started to immediately notice problems with house. Punch list given to builder on 10/06/08. On punch list it stated car drive apron was cracked on right side and listed other problems such Jacuzzi tub had holes in it where tilers had drop tiles thru tub. More problems started to appear so I requested a home inspector come out and go through my house because I was worried the foundation was not sound. Inspection found sub-prime floors was a immediate problem and that is structural in nature because all walls built on flooring. Inspection done by home inspector on 01/31/09. Home inspection report forwarded to builder on or about 02/06/09 by Real Estate agent, Mrs. Holly Long. Builder repeatedly call by estate agent to honor home inspection report and warranty, but to no avail. Builder refuse to honor warranty or home inspection report. In the mean time one of the garage windows has gas problem between double glazing and Stucco on front garage wall cracked. Brick in fire place cracked and outside brick on bedroom side cracked. All lintels over windows were rusted and paid out of my pocket to have this item corrected. All windows were not silicone sealed properly. Door in house not painted properly and corking in house not done right. Room above garage has several problems i.e., flooring, nail punched tthru the wall and repaired but not painted. Some installation in attic missing and used fire place once and almost burnt up outside wall and roofing guttering. Sun deck was not stained and had to be done immediately. This has been one problem after another and builder has not tried to correct major problems and has stated that I'm to demanding. Have not seen builder since February 2009.

In August 2005 we lost our home to a fire caused by a lightning strike. It was the day before school started and our son was home. He safely evacuated the house, save his dogs and called the fire department. With no injuries of lose of life I figured we would be fine since we were insured. Two days after the fire I meet the insurance adjuster at the house for his initial inspection. During this visit he asked who would do the repairs and I informed him I had no idea. He told me they had preferred vendors and I told his that was fine. He contacted Paul Davis Restoration Tampa East who showed up to secure the home to prevent further lose or injury to neighbor kids messing around. That night I signed a contract with PDR to do the repairs. During the rebuilding process there were numerous delays and other poor workmanship issues that were point out. This included crooked walls, crooked doors, and generally poor quality work. These issues were brought to the attention of the company on several occasions with no corrective actions taking place. One critical issue that came up was the installation of the gas lines. It turns out the company never drew a gas permit even though all the gas lines from the garage though the house had to be replace. They knew this because the gas line run through the attic and the entire roof system (except the garage) was removed. This was pointed out in a July 2006 inspection where the inspector note "gas permit needed". This was again addressed in Aug 2006 when it was again noted by the inspector "gas permit". In March 2007 Blair and Company Investments INC d/b/a Paul Davis Restoration Tampa East filed a foreclosure suit on our property. Because we refused to make the final payment they had placed a lien on out property. In the process of the suit we were required to get professional engineers and other contractors to inspect the house. During these inspections thing got even worse. In addition to the known and visible poor workmanship the inspections discovered additional code violations and other material issues that were not previously known. These included - Life Safety issues as documented by both a states licensed engineer and state licensed standards inspector – Several trusses had been cut in half in the top cord, piggyback trusses are not installed in accordance with engineering diagram, proper bracing not in place, hurricane straps not properly installed, straps installed do not meet the engineers plans or truss design - Code violations – In addition to the truss issues above, 1/2 inch sheetrock was installed in the ceiling where the code (and contract) call for 5/8”, electrical junction boxes in the attic not properly installed, work not accomplished according to plans - Over charges - Charged for 5900 sf of roofing when roof is only 5400 sf, Charged for double the actual size of gables, charged for 5/8" sheetrock on the ceiling but only installed ½”, and other over charged based on our allowance in the estimate and what was selected. - Labor and materials not used – Charged for foam board insulation in walls but was installed foil instead, charged to reinstall 40 year shingles - 30 year shingle were used instead, charged for 5/8" sheetrock on ceiling 1/2" inch installed (not only over charged but code violation as well), charged for 3 pc crown mold not installed This company has been negligent in their construction and committed what I consider fraud by replacing contracted materials with sub standard materials and charging for work and materials that were never used. I am sure numerous other homeowner are victims of similar circumstance and I would guess possibly even by this specific company. In addition to all the above this has consumed nearly 3 years of our lives since our return to the house and caused us great financial debt in order to defend ourselves and our equity in the house. People need to know the loss of the house is only the start of the problem many pitfalls await you in the recovery especially if they chose Paul Davis Restoration.

This is a condominium unit with someone living above me. The builder did not put any insullation on this home and as a result I can hear the the people upstairs talking, children running around, basically everything they do and talk about even when they whisper. Ryan Homes have denied any wrong doing but the State of Maryland Inspectors keeps approving their building plans everywhere. The condo association hired its engineering and it was discovered that the buildings failed the noise test. I have also filed a formal complaint to the Attorney General. The loans made to most of the people the community were falsified by builder's lender - NVR.

I have MAJOR MAJOR issues with my home built by DR Horton. The front door to my home is warped so bad there is air coming in from outside at the bottom of door. The windows have condensation on the inside of my windows. The upstairs floor has partical board that was nailed down and not properly placed so now u can hear how the floor is separating. The air condition is way to small for the square-footage of my home. I have sewage backup inside my home every couple of months because the pipes leading to the sewer go up 2 slopes before it travels down to sewer. I have cracking walls in my living room.
