Montemayor's mold decision protects insurance industry.

It was very disappointing to see Commissioner Montemayor's decision
about future mold coverage in Texas. It was advertised as "Montemayor Protects
Consumer Choice" on the Texas Department of Insurance website, allowing
homeowners to buy back the coverage, which they just lost, for outrageous
prices. The decision adequately protects the profits of the Insurance industry
but does absolutely nothing to protect those who are devastated by this
issue.
The Commissioner and this State understands the health risks of mold
contamination, for we as taxpayers were tapped for the remediation of mold
from then Governor Bush's Mansion, from the Attorney General's office,
and from other
state buildings. Those critical of homeowner maintenance as the cause
of mold contamination, have yet to criticize Mrs. Bush or Attorney General
Cornyn on their lack of maintenance with Clorox and a mop. Yet they are
the first to criticize the homeowners who turned to lawyers for help when
they find no one in Texas, including the Governor and Attorney General
are willing to offer assistance.
The Commissioner, during 4 separate hearings has failed to hear the
pleas for help from homeowners who have lost their homes to this real problem
of toxic mold contamination. Many have left their homes in order to protect
their family's health. And now they are required to find alternative housing
at their own cost while continuing to pay their original mortgage. All
this while trying to raise a family, work, pay bills, and be responsible
citizens.
What was heard, loud and clear, was the whining by the Insurance Industry
and their continued threats to stop offering coverage to homeowners. Even
with this protective ruling, they continue to whine and threaten, while
the homeowners have been left with little, if any protection, for their
homes.
All Texas homeowners will eventually feel this impact. As protection
for insurance industry's profits increases, so will your rates. Those purchasing
a new home will also have to purchase the full "optional" mold coverage
at a 54% increase in your current premiums. It will be required by the
mortgage companies to protect their investments. And those not wanting
or who can't afford the optional insurance, are left to play Russian roulette
with mold contamination.
Governor Perry called this decision "a fair and balanced response to
the no-win issue of mold coverage and homeowners' insurance". This is easy
for him to say. His home, the Governors Mansion, was remediated of mold
contamination, by the very best insurance money can by, our tax dollar.
