Homeowners Against Deficient Dwellings (HADD), a national non-profit consumer advocacy organization released a new report identifying extreme limitations and loopholes in new home warranties. The report, "New Home Warranties. Deception or Protection?" analyzes the warranties used by the majority of builders in Texas and highlights the limitations, exclusions, and unreasonable maintenance requirements common to each warranty. "This year, the Texas Homebuilding Association has asked our State Legislators to create a State sponsored Building Commission and performance standards for new home construction based upon these warranties. These performance standards are extremely limited, unreasonable, and should serve as a warning to our elected officials." says John R. Cobarruvias newly appointed President of HADD Texas. The vast majority of new homebuyers blinded by low interest rates, do not take the time to understand the limitations, exclusions, and maintenance required to maintain the warranty and assume their life-long investment has adequate protection. Because of this assumption many homeowners when faced with an expensive repair, are shocked to learn the extreme limitations of their warranty. As one example, many homeowners incorrectly believe their home is covered for foundation failures for a full 10 years. This is not true for any of the warranties reviewed for the report. Because of the extreme limitations and unreasonable maintenance required for the foundation by the homeowner, few damaged foundations would qualify for warranty repairs. "Texas lawmakers, as well as all new homebuyers should read these warranties before making any decisions. Unlike a car with 10 year, 100,000 mile bumper to bumper coverage, these warranties and performance standards are unreasonable, leaving the biggest investment of a lifetime, a new home, with the least amount of consumer protection" says Nancy Seats National President of HADD. "We hope this report will be useful to State Lawmakers when considering new legislation concerning new home construction and consumer protection." New homebuyers are urged to read and understand their warranty prior to the purchase and have a state licensed inspector inspect the home for defects prior to occupancy.
